The Best Weather Products (hereinafter referred to as the "Best Weather" or "we") greatly value the protection of user's privacy. In order to enhance your use of the Best Weather and improve user experience, we need to acquire certain users' personal data during use. Best Weather will, in accordance with relevant laws and regulations, take adequate protective measures in obtaining and managing your person data to ensure its safety and controllability. To this end, we have formulated this Best Weather Privacy Policy (hereinafter referred to as the "Policy"). Please read this Policy carefully prior to using Best Weather. By using or continuing to use Best Weather, you have understood and accepted all the terms of this Policy. If you do not agree any of the terms hereof, you shall immediately cease using our products and services.

We will collect and use your personal data for the purposes as stated herein and will not do so in a mandatory binding manner simply because you agree to this Policy. When you use or activate relevant features or services, we will collect and use your relevant data to the extent necessary to implement such features or services. Except for the information necessary to realize the basic business features of the Product or as required by the laws and regulations, you may elect to refuse to provide additional information which will not affect other features or services of the Product. 1. How we collect and use your personal data

i. Collection and use of personal data

Best Weather will collect and use your personal data in strict accordance with the provisions set forth in this Policy and its updates. Your personal data will only be used for purposes identified and agreed upon by you at the time of collection. For any other purposes, we will obtain your consent in advance.

i. In order to provide you with more accurate weather information, we will ask whether you agree to allow us to obtain your location information when you use Best Weather. If you do not agree, we will only provide weather services based on your IP address or your own manual selection, which may affect your access to the accurate weather forecast information of your location.

ii. During your use of Best Weather, we may, for purposes of statistical analysis and problem diagnosis, collect your device information (device brand, device model, system version number, application version number, application version name, application list, and network information), unique device identifier (MAC address, IMEI, IMSI, Android ID, IDFA, OAID), and network identifier (IP address).

iii. In order to better understand the operation of Best Weather and its related services and ensure the safety of software operation and the services, we will collect your network log information, as well as the frequency of your use of Best Weather and its related services, crash data, overall installation and usage, and performance data.

iv. Provision of personal data is not mandatory, but if you decide not to provide such data, you may be unable to use the products and services that require provision of such data, but this will not affect your use of Best Weather’s other features.

2. Obtaining user authorization

In order to provide you with improved product experience, we need you to grant us certain authorization when using the product. The request for authorization will appear in a pop-up window, and we will obtain the authorization only upon your consent. You can use related features or services only after we obtain your authorization. The authorizations we need are as follows:

android.permission.ACCESS_COARSE_LOCATION: Obtain rough location for access to GPS positioning

android.permission.ACCESS_FINE_LOCATION:Obtain precise location to acquire operator's information and provide interfaces for such information

android.permission.ACCESS_WIFI_STATE: Obtain Wi-Fi information, which will be used to implement the network positioning.

android.permission.CHANGE_WIFI_STATE: Change Wi-Fi information, which will be used to implement network positioning.

android.permission.INTERNET: Get access to the network, which is necessary for network positioning

android.permission.READ_PHONE_STATE: Obtain current state of mobile phone

android.permission.WRITE_EXTERNAL_STORAGE: Write data in cache to SD card

android.permission.ACCESS_LOCATION_EXTRA_COMMANDS: Request use of A-GPS module

If you elect not to grant such authorizations, you may be unable to use the features or services that require it to be granted, but this will not affect your use of other features of the Best Weather.

You may revoke the authorizations granted to us in "Settings" → "Rights Management" on your mobile phone.

3. Exemption from authorization and consent by operation of law

Please note that we do not need your authorization prior to collecting and using your personal data under the following circumstances:

i. Data related to national security and national defense security;

ii. Data related to public security, public health or major public interests;

iii. Data related to criminal investigation, prosecution, trial and execution of judgment;

iv. Data for the protection of your or others' lives, property or other important legal rights and interests, but where it is difficult to obtain the consent of the data owner;

v. Personal data that you disclose to the public;

vi. Personal data legitimately collected from public information, such as legitimate news reports, information disclosed by government etc.;

vii. Data necessary to enter into a contract based on your requirements;

viii. Data necessary to maintain the safe and stable operation of the products/services, such as finding and handling the failure of the products/services;

ix. Data necessary for legitimate news reports;

x. Data necessary for academic research institutions to carry out statistical or academic research for public interests, provided that the personal data contained in the results thereof disclosed to the public is not personally identifiable;

xi. Other circumstances as set forth by relevant laws and regulations.

2. How we use cookies and similar technologies

In order to provide an improved service experience, we will store small data files known as "cookies" on your computer or mobile device, which will be used to identify your login status and ensure data security. We use cookies and similar technologies mainly to achieve the following features or services:

We may set cookies or anonymous identifiers for authentication and security to enable us to confirm whether you have securely logged in the services, or whether you have encountered theft, fraud, or other illegal activities. These technologies will enable us to improve the efficiency of the services, increase login and response speed, help you avoid having to repeatedly fill in your personal information or enter search content, simplify operating steps and procedures, and help you achieve an easier access experience.

We will not use cookies for any purpose other than those stated in this policy. Currently, most browsers allow you to clear cookies, so you can use this feature in your browser. If you elect to clear or close cookies, some features or services may be unavailable.

3. How we share, transfer and publicly disclose your personal data

(i) Sharing

a. Sharing with express consent: Subject to your express consent, we will share your licensed personal privacy data with the third party designated by you;

b. Sharing by operation of law: We may share your personal data in accordance with laws and regulations, for the purpose of dispute resolution, or as required by administrative and judicial authorities;

c. Sharing with research and academic institutions: Your data may be shared with our research partners and academic institutions to conduct research, achieve academic results and innovation that can support our business or mission, and promote exploration and innovation for the purpose of social welfare, technological progress, public interests, health and benefits.

d. Sharing with business partners: We may share your order and equipment information with our partners and other third parties to ensure fulfillment of services provided to you. However, we will only share your personal data for lawful, legitimate, necessary, specific and explicit purposes and to the extent necessary to provide the services. Our partners will not be entitled to use the shared personal data for any other purpose. Our partners include:

a. Third-party sellers and third-party developers: Some products or services will be provided directly by third parties, so we must share the transaction information with such parties so that you can purchase products or services from them. For example, when you purchase products from other developers in Best Weather, we must share your data with the developers before the transaction can be completed. 

b. Supplier of technical services: We may share your personal data with any third party that supports our features, including the third party that provides us with infrastructure technical services, payment services and data processing services. We share such data for the purpose of realizing the features of our products and services. For example, we need to share your order number and amount with the third-party payment agency for it to confirm your payment order and completion of payment.

c. Link to third-party website: Our services will incorporate links to other websites whose privacy measures may differ from those of Best Weather. If you submit your personal data to any of these websites, your data will be subject to their privacy policies. We encourage you to carefully read such privacy policies of the third-party website you visit.

(ii) Transfer

In the event that we undergo a restructure, merge or sale, we will continue to maintain the confidentiality of all personal data we collect and notify all the affected users in accordance with our current privacy policy prior to transferring such data. Meanwhile, we will require the new company or organization that retains your personal data to comply with this policy. Otherwise, we will require the company or organization to seek authorization from you again.

(iii) Public disclosure

We will publicly disclose your personal data only under the following circumstances:

a. Disclosure upon your express consent;

b. Disclosure based on legal or justifiable grounds: We may publicly disclose your personal data in line with the type of data and the manner of disclosure as required by laws, regulations and mandatory administrative or judicial requirements. Subject to relevant laws and regulations, when we receive such request for disclosure, we will require appropriate legal documents, such as subpoenas or letters of investigation.

c. Disclosure necessary to comply with applicable laws and regulations, safeguard public interests, or protect the personal and property safety, legal rights and interests of us, our affiliates, our customers, other users or employees, or public safety and interests, as well as other disclosure in line with the service terms and policies of Best Weather or that we deem appropriate.

4. How we store and protect your personal data

(i) How we store your personal data

a. The personal data you submit to Best Weather will be stored on servers in the People's Republic of China. Please note that your use of Best Weather services and submission of your data to us will indicate that you have agreed to transmit the data to China for processing and storage. The data protection standards and privacy laws in this country may differ from those applicable in your country of residence.

b. We will only retain your personal data for the period necessary to achieve the purposes stated in this policy and as required by laws and regulations. After the retention period expires, we will delete or anonymize your personal data in accordance with relevant laws and regulations.

c. In case of termination of our services or operation, we will promptly cease collecting your personal data and notify you via one-by-one delivery, message push or public notice. In any event, we will delete or anonymize your personal data stored by us after we terminate our services or operation.

(ii) How we protect your personal data

a. We will use encryption to ensure the confidentiality of data transmission and storage. We will use trusted protection mechanisms to protect the data and the servers on which it is stored from malicious attacks.

b. We will establish management systems and processes in compliance with applicable regulations, and we will review the collection, storage and processing of data (including physical security measures) to prevent any unauthorized access to our systems.

c. We will strictly limit the scope and authority of those who have access to the data, and only employees and persons who need to know the data in assistance to or on behalf of us to process the data can access such data, provided that they shall strictly perform the obligations of confidentiality. Failure to fulfill these obligations may result in legal liabilities or termination of their relationship with Best Weather.

d. Please note that due to technical constraints and various malicious acts on the Internet, even if we try our utmost to enhance security measures, we cannot guarantee the data will be secure at all times, but we will still do our best to ensure the security of your personal data. Please note that the systems and communication networks you use to access our services may fail due to the factors beyond our control.

e. We would like to remind you that the measures for the protection of your personal data provided in this policy only apply to Best Weather and its related services. Once you leave Best Weather, or visit or use other websites, services and content, we will not be able or liable to protect any personal data you submit to software or websites other than Best Weather and its related services, whether or not you log in, browse or use such software or websites as directed by the link or guide in Best Weather.

5. How you manage your personal data

(i) Access to and correction of personal data

While we protect your personal data, you also have the right to inquire and correct your personal data we retain. If you intend to exercise these rights, you may contact us in the manner specified in "How to contact us".

(ii) Deletion of and restriction on personal data

If you intend to delete or restrict the use of your personal data, we will conduct the deletion or restriction per your request to the extent permitted by law.

If we decide to conduct the deletion upon your request, we will also notify the entities that have obtained your personal data from us to delete such data in a timely manner, unless otherwise provided by laws and regulations, or such entities have obtained your authorization separately.

When you delete your data from our services, we may not, due to applicable laws and security technologies, delete the corresponding data from the backup system immediately. We will securely store and further isolate your personal data so that it remains unretrievable and inaccessible in the products we provide until the backup is deleted or made anonymous.

(iii) Revocation of consent or authorization

The implementation of each feature requires some basic personal data, so if you revoke your authorization or consent, we will no longer be able to provide you with the features and services related to such consent or authorization and will no longer process your personal data. However, your revocation will not affect our collection or use of your data previously authorized by you.

You may change or revoke the authorization you provided for us to collect your personal data by deleting data, turning off device features, changing privacy settings in terminal devices or apps.

(iv) Obtaining copy of personal data

You may contact us in the manner provided in "How to contact us". After verifying your identity, we will provide you with a copy of your personal data upon your request, except as otherwise provided by laws and regulations or agreed in this policy.

To the extent technically feasible, if the data interface matches, we can also, upon your request, transfer a copy of your personal data directly to a third party you designate.

(v) Restriction on automatic decision-making based on information system

In some features, we may make decisions based only on automatic decision-making mechanisms such as information systems, algorithms etc. If these decisions significantly affect your legitimate rights and interests, you may request an explanation from us and we will provide the appropriate remedies.

(vi) Response to your request

For security reasons, you may be asked to submit a written request or otherwise prove your identity. We may ask you to verify your identity prior to processing your request. We will respond to your request within 15 working days.

In principle, we will not charge you for a reasonable request. However, for repeated requests beyond a unreasonable limit, we will charge you certain fee as on a case-by-case basis. We may not be able to respond to requests that are repeated and unreasonable, or those that involve excessive technical means (e.g. require the development of new systems or fundamentally change existing practices), pose a risk to legal rights and interests of others, or are highly impractical (e.g. related to data stored in backup).

We will not be able to respond to your request if:

a. the data is related to its controller's performance of the obligations prescribed by laws and regulations;

b. the data is directly related to national security and national defense security;

c. the data is directly related to public security, public health or major public interests;

d. the data is directly related to criminal investigation, prosecution, trial and execution of judgment;

e. the controller of the personal data has sufficient evidence indicating that the data subject has malicious intent or abuses his/her rights;

vi. the data for the protection of data subject's or other's life, property or other important legitimate rights and interests, but it is difficult to obtain the consent of the data owner;

vii. the response to the request of the data subject will seriously harm the legitimate rights and interests of the data subject, other individuals or organizations;

viii. the data is related to trade secrets.

6. How we handle the personal data of minors

(i) Best Weather products are provided primarily for adults, but for minors who use its products and services, we are aware of the importance of taking extra precautions to protect their privacy and safety. We consider any person under the age of 16 (or such lower age not less than 13 as permitted by applicable local laws) as a minor. If you are a minor, please ask your guardian to carefully read this policy and obtain his/her prior consent before using our products and services or providing us with your personal data. If you are the guardian of a minor, you should carefully read and understand the content of this policy before agreeing to the minor using our products and services or providing us with his/her personal data.

(ii) With respect to a minor's personal data that we collect subject to the consent of his/her guardian, we will only use or disclose such data as permitted by law, expressly approved by the guardians or necessary for the protection of minor. If your guardian does not consent to your use of our products and services or provision of your data to us in accordance with this policy, please immediately cease using Best Weather and inform us promptly.

(iii) If you are the guardian of a minor, please contact us in the manner described in "How to contact us" when you need to access, modify or delete the personal data related to the minor under your custody.

(iv) If we find that we have collected personal data from a minor without prior consent of his/her verifiable guardian, we will attempt to delete the data as soon as possible.

7. Modifications of and amendments to this policy

(i) For the purpose of developing our business and providing you with improved products and services, this policy will be updated. Without your express consent, we will not impair your rights under this policy except by sending you a notice at the email address you have provided or posting a notice on the website bulletin.

(ii) In the event of a change or revision of this policy, we will remind you thereof by sending you a pop-up message in Best Weather. In such circumstances, your continued use of our services means that you agree to accept the revised policy.

9.Notice of General Data Protection Regulation (GDPR)

Privacy of Minors in the EU: To the extent that GDPR applies, we will not knowingly collect the personal data of the children under the age of 16 (or such lower age not less than 13 as permitted by applicable local laws).

International Transmission: If GDPR applies in your region, the data we collect (including that collected through cookies) will be processed and stored in China. The data protection and privacy laws in this country may differ from those applicable in your country or region.

Your use of Best Weather services and submission of your data to us will mean you agree to transmit the data to China for processing and storage.

Basis of data processing: Our processing of your personal data in order to provide services for you is generally based on one of the following grounds:

a.You have provided us with your specific, clear, voluntary and express consent.

b.We need to process the data in order to provide you with the services or certain features of the services, i.e., we cannot fulfill your request if we do not process the data.

c.Processing the data is necessary for the purposes of our legitimate rights and interests or those pursued by any third party, if any, to the extent that your privacy and related rights cannot prevail over such legitimate interests. Our legitimate rights and interests include provision of weather-related products and services.

10. Other privacy laws

We understand that privacy laws are evolving in various countries, such as state laws in the United States (e.g. the laws of California, Colorado, Virginia, etc.) and privacy laws in other countries (e.g. Brazil's Law on General Protection of Data (LGPD), Turkey's Law on Protection of Personal Data (LPPD), Mexico's Federal Law on Personal Data Protection Obligations of Private Subject, Japan's Personal Data Protection Law, etc.), which will protect the rights of users located in these jurisdictions. We respect the privacy rights of all our users and will comply with these privacy laws.
